Bus rolls up onto curb and strikes pedestrian who was waiting for the walk sign at light.
(City had initially denied responsibility for a city bus accident. We were able to obtain video to prove our pedestrian client was struck by a bus that had driven up over the curb as it was turning and struck our client causing her injuries. The city then decided to settle the claim).
Our client first came to us because a city bus had run into her as a pedestrian and the city was denying her claim. The bus driver claimed that our client was not paying attention and walked into the side of the bus. Our client said this was not true, that she was standing still when the bus came up onto the curb and struck her. We did an open records request for all video of the collision so we could verify what happened.
Upon receiving the video, our client was standing still on the street corner downtown waiting on the walk sign so she could cross the street to go north across the street. As she was waiting a city bus heading north turned right to go east at the corner where she was standing. The bus crossed over the curb and struck our client from behind knocking her into a light pole and onto the ground causing injuries. The video proved that our client was telling the truth about how the collision occurred, and the city changed their tune and paid the entire claim.
